What is a 1031 exchange?
A 1031 exchange lets real estate owners defer capital gains taxes by reinvesting sale proceeds into "like‑kind" investment property within 180 days. The process must be facilitated by a Qualified Intermediary, and Northmarq 1031, LLC provides these services to help guide you through each step.
What types of properties qualify as “like-kind”?
“Like-kind” is interpreted broadly. Virtually all real property held for investment or business use can be exchanged for any other type of real property, including land, office, retail, industrial or even DST interests. The asset class doesn’t need to match. The key is that both properties qualify as real property under IRS rules and are held for investment purposes.
What are the tax implications if I miss a deadline or don’t reinvest fully?
Missing the 45‑day identification or 180‑day closing deadlines usually disqualifies the exchange, making the sale fully taxable. Likewise, failing to reinvest all proceeds or acquire equal or greater value results in taxable “boot,” which creates an immediate tax liability.
